These Terms of Sale (“Terms”) govern all purchases made through TelaModa.com and apply to all products and services offered by TelaModa LLC (“TelaModa,” “we,” “our,” or “us”).
By placing an order through our Website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Sale, as well as our Terms of Use and Privacy Policy.
1. Eligibility
By placing an order, you represent and warrant that:
- You are at least 18 years of age or have the permission of a parent or legal guardian.
- All information you provide is accurate and complete.
- You are authorized to use the payment method submitted.
- Sufficient funds are available to complete your purchase.
2. Pricing
We strive to ensure that all product descriptions, pricing, and availability are accurate. However, errors may occasionally occur.
TelaModa reserves the right to correct pricing, typographical, or product description errors at any time without prior notice.
If an incorrect price has been displayed, we reserve the right to cancel the order before shipment. If payment has already been processed, a full refund will be issued.
Prices are subject to change without notice.
Applicable taxes and shipping charges will be calculated during checkout.
3. Product Availability
All products are subject to availability.
TelaModa reserves the right to discontinue products, modify collections, limit quantities, or refuse any order at our sole discretion.
4. Order Acceptance
After placing an order, you will receive an order confirmation acknowledging receipt of your purchase request.
This confirmation does not constitute acceptance of the order.
An order is considered accepted only when your purchase has been processed and shipped.
TelaModa reserves the right to refuse or cancel any order for reasons including, but not limited to:
- Product unavailability
- Pricing errors
- Payment authorization issues
- Suspected fraud
- Violation of these Terms
5. Payment
Payment authorization is completed at the time your order is placed.
Orders will not enter production or shipment until payment has been successfully authorized.
TelaModa accepts approved payment methods displayed during checkout.
6. Shipping & Delivery
Orders are shipped using the shipping method selected during checkout.
Estimated delivery dates are provided for convenience only and are not guaranteed.
TelaModa is not responsible for delays caused by:
- Weather
- Customs processing
- Shipping carriers
- Labor disruptions
- Government actions
- Natural disasters
- Force majeure events
- Circumstances beyond our reasonable control
Risk of loss transfers to the customer once the order has been delivered to the shipping carrier.
7. Customer Inspection
Customers should inspect all merchandise immediately upon delivery.
Any visible damage, defects, or shipping issues must be reported in writing to info@telamoda.com within 72 hours (3 days) of delivery.
If no written notice is received within this period, the merchandise will be considered accepted.
8. Returns for Eligible Non-Custom Merchandise
Eligible non-custom merchandise may be returned within 72 hours of delivery, provided that:
- The item is unused, unworn, and in original condition.
- Original packaging, tags, and accessories are included.
- A Return Authorization (RA) has been issued by TelaModa.
- The return is shipped within three (3) business days of receiving the RA.
Returns received without prior authorization will not be accepted.
Customers are responsible for return shipping costs.
Original shipping charges are non-refundable.
9. Refunds
Returned merchandise will be inspected upon receipt.
If approved:
- Refunds will be issued to the original payment method.
- Original shipping charges are non-refundable.
- A 15% restocking fee will be deducted from the refund.
If merchandise has been worn, altered, damaged, or cannot be resold, TelaModa reserves the right to reduce or deny the refund based on the item’s condition.
10. Order Changes & Cancellations
Orders may not be canceled, modified, or delayed after they have been accepted without TelaModa’s prior written approval.
If a cancellation is approved, processing costs, production expenses, and applicable restocking fees may be deducted from any refund.
11. Custom, Personalized & One-of-One Orders
All custom, commissioned, personalized, made-to-order, and one-of-one wearable art pieces are final sale.
This includes, but is not limited to:
- Wedding attire
- Event apparel
- Couture garments
- Hand-painted accessories
- Personalized artwork
- Artwork created on customer-supplied items
- Limited-edition commissioned pieces
These orders:
- Cannot be canceled after design approval.
- Cannot be exchanged.
- Cannot be returned.
- Are not eligible for refunds.
Full payment may be required before production begins.
12. Design Consultations & Mock-Ups
TelaModa may, at its discretion, provide digital concepts, artwork previews, or design mock-ups before production begins.
Any consultation, design, or mock-up fees will be disclosed and approved before work commences.
Approved design fees may be applied toward the final purchase when specified by TelaModa.
13. Handmade & Color Variations
Every TelaModa creation is individually handcrafted.
Due to the artistic nature of our work, slight variations in:
- Color
- Brushwork
- Texture
- Pattern placement
- Materials
- Finish
- Stitching
are normal and contribute to the uniqueness of each piece.
Colors displayed on digital devices may differ slightly from the final product due to monitor settings and photography.
These natural variations are not considered defects.
14. Disclaimer of Warranties
Except where prohibited by law, all products are sold “AS IS” and “AS AVAILABLE.”
TelaModa disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
15. Limitation of Liability
To the fullest extent permitted by law, TelaModa LLC shall not be liable for indirect, incidental, consequential, punitive, or special damages arising from the purchase or use of any product.
Where permitted by law, TelaModa’s total liability shall not exceed the amount actually paid by the customer for the product giving rise to the claim.
16. Governing Law
These Terms of Sale shall be governed by the laws of the State of New York.
Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in New York.
17. Changes to These Terms
TelaModa reserves the right to revise these Terms of Sale at any time.
Updated versions become effective immediately upon publication on this Website.
