Welcome to TelaModa. These Terms & Conditions govern your use of www.telamoda.com and the purchase of products and services offered by TelaModa. By accessing our website or placing an order, you agree to be bound by these terms.
1. About TelaModa
TelaModa creates original wearable art, luxury accessories, custom fashion, and one-of-a-kind pieces. Every design is produced with exceptional attention to craftsmanship, making each creation unique.
2. Acceptance of Orders
All orders are subject to product availability and acceptance by TelaModa.
After placing an order, you will receive an order confirmation acknowledging receipt. This confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel any order at our sole discretion.
3. Pricing
All prices are listed in U.S. Dollars (USD).
Although we strive for accuracy, pricing errors may occasionally occur. If an error is discovered, we reserve the right to cancel the order or contact you with the corrected pricing before processing.
Prices may change without prior notice.
4. Payment
Payment is required at the time an order is placed.
We accept major payment methods displayed during checkout. Orders will not be processed until payment has been successfully authorized.
5. Shipping & Delivery
Shipping options and estimated delivery times are displayed during checkout.
Delivery dates are estimates only and are not guaranteed.
TelaModa is not responsible for shipping delays caused by carriers, customs, weather, strikes, or other events beyond our control.
Risk of loss transfers to the customer once the shipment has been delivered to the shipping carrier.
6. Order Inspection
Please inspect your order immediately upon delivery.
If your order arrives damaged or incorrect, you must contact us within 72 hours of delivery with photographs and your order information so we may assist you.
7. Returns
Eligible non-custom items may be returned within 72 hours of delivery.
Returned merchandise must:
- Be unused
- Be in original condition
- Include original packaging
- Include proof of purchase
Return shipping costs are the responsibility of the customer unless the return is due to our error.
Original shipping charges are non-refundable.
8. Custom Orders
Because custom creations are designed specifically for each client, all custom and personalized orders are final sale.
This includes:
- Custom wearable art
- Personalized accessories
- Bridal and wedding commissions
- Event commissions
- Hand-painted customer-owned items
- Special commissioned artwork
Production begins once the design has been approved by the client.
Approved custom orders cannot be canceled, exchanged, or refunded.
9. Design Mockups
If design mockups are offered as part of a custom project, applicable design fees will be communicated before work begins.
Unless otherwise stated, mockup fees are non-refundable but may be credited toward the final commissioned project at TelaModa’s discretion.
10. Product Variations
Each TelaModa creation is individually handcrafted.
Natural variations in color, brushwork, texture, placement, and materials are part of the artistic process and should not be considered defects.
Product images are intended as representations only. Colors may vary depending on monitor or device settings.
11. Intellectual Property
All artwork, designs, photographs, product images, logos, branding, graphics, website content, and original creative works remain the exclusive property of TelaModa.
No content may be copied, reproduced, distributed, modified, or used without prior written permission.
12. Website Use
You agree not to:
- Use the website for unlawful purposes
- Attempt unauthorized access to our systems
- Copy or scrape website content
- Interfere with the operation or security of the website
13. Limitation of Liability
To the fullest extent permitted by law, TelaModa shall not be liable for indirect, incidental, consequential, or special damages arising from the use of our website, products, or services.
Our total liability shall never exceed the amount paid for the applicable order.
14. Warranty Disclaimer
All products and services are provided “as is” except where required by applicable law.
Because every artwork is handcrafted, no guarantee is made that individual pieces will be identical to photographs or previous commissions.
15. Governing Law
These Terms & Conditions shall be governed by the laws of the State of New York, without regard to conflict of law principles.
Any disputes arising under these terms shall be resolved in the appropriate state or federal courts located in New York.
16. Changes to These Terms
TelaModa reserves the right to update these Terms & Conditions at any time.
Revisions become effective immediately upon publication on this website.
